Rental Agreement

ELECTRIC CAR, MOTOR SCOOTER, BICYCLE, HEREIN: “VEHICLE” RENTAL AGREEMENT

  • between HAMPTON BEACH SCOOTERS, LLC., a New Hampshire Corporation, and:
  • CUSTOMER NOTE: Credit Card charges will appear on statement as "Hampton Beach Scooters, LLC."
  • IT IS EXPRESSLY UNDERSTOOD BY AND BETWEEN THE PARTIES TO THIS AGREEMENT THAT: The rental terms and conditions set forth on this agreement shall constitute the full and complete contract between Hampton Beach Scooters, LLC. Hereinafter called the LESSOR, and the undersigned renter, hereinafter called the LESSEE, and no other terms or warranties expressed or implied shall alter the strict meaning and understanding of this agreement.
  • CUSTOMER AGREES TO THE FOLLOWING RENTAL CONDITIONS:
    1. The use of the VEHICLE is inherently dangerous and could result in severe personal injury and/or death. Therefore, neither the LESSOR nor any of the Released Parties are responsible for any personal injury or death resulting from the use of any vehicle rented to the LESSEE. The LESSEE shall be solely responsible for any personal injury caused or sustained while using, or in the possession of, the Vehicle. The LESSEE shall waive any claims and have no recourse whatsoever for any money damages to the LESSEE or any other party; and
    2. LESSEE agrees that no alcoholic beverages of any kind or quantity, no mood-altering or narcotic substances whatsoever, whether or not prescribed by a physician; and no personal accoutrements of any kind which may serve to increase the risk of operating the vehicle may be used by LESSEE during the time that the LESSEE has the vehicle in his/her use, possession and control; and
    3. LESSEE agrees to return the Vehicle in the same condition as when it was rented, or to pay the full cost of repairs to restore the Vehicle to its original condition. LESSEE also assumes liability for, and agrees to promptly pay, all fines, penalties, or forfeitures imposed on LESSEE or Vehicle for trafficking, and any other violation of the law while the Vehicle is held, used, and/or operated by the LESSEE; and
    4. LESSEE is aware that the rental of the vehicle includes no insurance of any kind to indemnify for any loss to the Lessee's person or property or the person or property of any other person with whom the Lessee may have contact during the term of this agreement. Further, the Lessee agrees to defend and hold harmless the Lessor, or any employee of LESSOR, and all of the Released Parties from and against all claims arising from the rental of this vehicle from LESSOR and asserted by reason of LESSEE's use of operation of the vehicle, and to pay all costs. judgments, liens, penalties, and attorney's fees resulting from, that may be levied against the LESSOR or any employee of the LESSOR, and all of the Released Parties arising out of the LESSEE's use of the vehicle including loss or damage due to theft, fire, accident, or any other cause whatsoever; and
    5. LESSEE agrees to wear a helmet outside the state limits of New Hampshire and LESSOR recommends that all riders wear helmets at all times; and LESSEE shall not allow more than one rider on any vehicle that is designed for a single rider. If the LESSEE violates this provision and damage to the vehicle results, the LESSEE shall be fully responsible; and
    6. LESSEE or passenger hereby warrants that they are not pregnant.
    7. Any passenger must wear protective eye wear and is encouraged to wear appropriate footwear. LESSEE must be at least 18 years of age and no rider under the age of 18 is allowed at any time.
    8. LESSEE has ridden and inspected the vehicle prior to the execution of the rental agreement and by the execution of this agreement agrees that the vehicle is in good mechanical condition.
    9. LESSEE is eighteen (18) years of age or older and has been strongly encouraged to wear a helmet, eye protection as well as appropriate footwear. The LESSEE has elected not to make use of the loaner helmet and eye protection provided by the LESSOR; and
    10. As a parent or guardian of a minor, LESSEE hereby execute the foregoing instrument in the capacity stated with full knowledge of the terms hereof and the risk involved.
    11. THE UNDERSIGNED AGREES THAT A CREDIT CARD IMPRINT IS SIGNED AND IS BLANK. THE IMPRINT IS USED FOR A SECURITY DEPOSIT IN THE EVENT OF ANY DAMAGE, STOLEN VEHICLE, FINES, AND LOSS OF REVENUE OF SAID EQUIPMENT. THE UNDERSIGNED GRANTS PERMISSION TO HAMPTON BEACH SCOOTERS, LLC., TO CHARGE ANY DAMAGES THAT MAY OCCUR WHILE IN POSSESSION OF THE ABOVE EQUIPMENT AND ANY OTHER VEHICLE THAT MIGHT BE DAMAGED, DESTROYED, OR STOLEN THAT INVOLVES THE UNDERSIGNED. ALL CHARGES ARE NOT FINAL AUDIT, IN THE EVENT FOR ANY UNFORESEEN CHARGES AT THE TIME OF THE ESTIMATE, THE UNDERSIGNED GIVES FULL AUTHORIZATION TO CHARGE ADDITIONAL CHARGES TO THE CREDIT CARD IMPRINT. NO REFUNDS FOR EARLY RETURNS.
  • LOST KEYS $ 50.00 LOST HELMET $50.00 CANCELLATION FEE - MORE THAN 48 HOURS BEFORE RESERVATION 20% WITHIN 48 HOURS OF RESERVATION FULL COST For the consideration set forth above, the LESSOR agrees to and does herewith provide for the sole and exclusive use of the LESSEE the VEHICLE indicated above for the period indicated above. LESSEE agrees that he/she shall protect, indemnify, defend and hold harmless HAMPTON BEACH SCOOTERS, LLC., FLEURY GROUP, LLC A NEW HAMPSHIRE LIMITED LIABILITY COMPANY AND ITS MEMBERS, the owner of the property from which the scooter was rented and its franchisors, lenders, property managers and their respective officers, directors, shareholders, partners, and employees (collectively the "Released Parties") from and against any and all claims arising from the rental of this Vehicle from the LESSOR from any cause whatsoever. IMPROPER USE OF THE VEHICLE, AS DETERMINED SOLELY BY THE LESSOR OR ANY AGENT OF THE LESSOR SHALL RESULT IN IMMEDIATE CONFISCATION OF THE VEHICLE. There shall be no refund of any monies paid in the event of the LESSOR's confiscation of the Vehicle and there will be no refunds given for any reason whatsoever (Weather, Personal Injury, Etc.). The LESSEE's initials to the left of each paragraph above indicate that the LESSEE has read, acknowledges and understands the paragraph. The LESSEE has provided the LESSOR a valid driver's license. I HAVE READ AND AGREE TO ALL TERMS AND CONDITIONS OF THIS RENTAL AGREEMENT AND UNDERSTAND THE LEGAL RIGHTS THAT I AM GIVING UP BY SIGNING THIS DOCUMENT.
